Thank you for visiting Daniel Weiss Photography. Below are the terms and conditions that govern the use of this site. By visiting this site you agree to the terms and conditions below in their entirety. When purchasing a print, you will be required to click an “I agree” button before purchasing one of our products or services. By clicking this button you agree that you have read, understood, and assent to all of the terms below in their entirety.

Privacy Policy and Data Disclaimer

We will only use your email and address for shipping purposes. We will not send you promotional or news emails with the email address you use at checkout. The only time we will send you emails is if you sign up to be on our mailing list. Your personal data will be stored in a private section of the developer’s version of the website that is password protected and secured by a different email address than is associated with the business side of this site for extra security. This data will never be shared with a third party without your consent.

Delivery Terms

We can not guarantee an exact delivery time, we go through third-party delivery services, and we cannot control any delays in shipping on their end. While we strive to develop the prints and ship them out within five days, we cannot guarantee a delivery date because of the un-foreseeability of life circumstances that may arise that would prevent the completion of this delivery to the shippers. When possible, we will attempt to provide you with a tracking number so you can see the status of your print.

We do offer deals on free shipping otherwise, to find out when there is free shipping site-wide, sign up to our mailing list. 

We offer standard ground shipping from the shipping companies at this point in time. Normally this takes 7-14 days and, as stated above, we take no responsibility for shipping delays on the end of the shipping company. For shipments overseas, we do offer shipping at an increased price because of the increase in costs in shipping overseas. This cost will reflect at checkout and may take longer than the standard shipping times.

Payment Terms

All payments made and prints purchased are final. Upon checkout, you will be prompted to pay with PayPal. The final price of the print will include shipping costs as well as taxes and fees. Once you click pay on the website, the sale is final and we do not offer refunds. You may submit a refund request, however, granting of a refund is solely up to the discretion of Daniel Weiss Photography. The prints will only be created and shipped upon the full amount of the payment going through and being received by us. For custom prints or events we will send you a price quote and agree to a final price with you through those communications. Those sales are also final and the project will only be completed after the full receipt of the payment. 

All of the prints sold are the sole intellectual property of Daniel Weiss and Daniel Weiss Photography. You do not have the right to copy, distribute, sell, or duplicate the work as your own. 

Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers, and expiration dates so that we can complete your transaction and contact you as needed. 

Product Information

Daniel Weiss Photography attempts to be as accurate as possible. However, Daniel Weiss Photography does not warrant that product descriptions and website content are accurate, free of errors, complete, or current. If any print ordered from danielweissphotography.com that you receive is defective, the wrong print, or damaged, it can be returned as-is.

Disclaimer of Warranties; Limitations of Liability

We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of our services or products will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the product is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided as is and as available for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. 

In no case shall Daniel Weiss Photography, or its photographers, employers, affiliates, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or any other claim related in any way to your use of the service or product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for the consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by the law. 

Dispute Clause

Any dispute relating to any activity on Daniel Weiss Photography or the purchase of any Daniel Weiss Photography products shall be submitted to confidential arbitration in King County, Washington unless you have in some way threatened or violated Daniel Weiss Photography’s intellectual property rights, whereby we may seek an injunctive or take legal action against you.

Copyrights and Intellectual Property

All of the prints and photographs available on danielweissphotography.com are the sole intellectual property of Daniel Weiss and Daniel Weiss Photography. Redistribution, copying, selling, duplicating, or otherwise passing this work off on your own is prohibited.
